Abstract

The COVID-19 pandemic has had an impact on the financial crisis of entrepreneurs as a result of which companies have had to stop their business activities, which in the end have been forced to lay off workers, lay off workers or cut wages. The purpose of this study was to find out the responsibilities of employers towards workers who were laid off, laid off, and had their wages cut due to the COVID-19 pandemic. This research is a normative-empirical research which is a research on normative legal provisions or statutory regulations in their action on legal events in a society, the process of which is still ongoing (live case study) at Cordela Hotel Medan. The data used are primary data and secondary data collected from field studies and literature studies. The data obtained were analyzed qualitatively. This study uses a statutory approach and a conceptual approach. The results of the research, during the period of economic difficulties due to the COVID-19 pandemic, there were 3 (three) forms of hotel entrepreneur policies towards their workers, namely laying off workers, cutting wages, and laying off their workers. The responsibility of employers towards their workers is based on good faith, where layoffs are sought not to occur and are carried out through bipartite negotiations. The responsibility of the employer is to pay wages that have been agreed to be deducted according to the ability of the entrepreneur. The employer's responsibility for the policy of laying off workers is also carried out based on the agreement with the worker, where the employer does not apply unpaid leave because this is the worker's right.
